These Terms of Use constitute a legal agreement between you and Service Provider. By accessing and using the M-LINX™ Customer WEB Portal (Order and Transaction) Module and all data and information available to you via such module, you agree to comply with these Terms of Use. If you do not agree to these Terms of Use, you are not permitted to access or use the M-LINX™ Customer WEB Portal (Order and Transaction) Module or the data and information available to you via such module. Service Provider reserves the right, at any time, to deactivate or suspend your access to the M-LINX™ Customer WEB Portal (Order and Transaction) Module if your use of it, or the data and information accessed through it, is found or reasonably suspected, in Service Provider’s judgment, to breach these Terms of Use. You agree that you will not:
- sell, assign or otherwise transfer your right to access and use the M-LINX™ Customer WEB Portal (Order and Transaction) Module or the data and information available to you via such module,
- copy, reproduce, modify, enhance, adapt, translate, sell, export, transfer, or prepare derivative works of, reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code or source data from the M-LINX™ Customer WEB Portal (Order and Transaction) Module except and only to the extent permitted or required by law,
- alter, remove, deface, cover or otherwise obscure any copyright, trademark, patent or other proprietary rights, notices, and any other markings Service Provider may have placed in or on the M-LINX™ Customer WEB Portal (Order and Transaction) Module;
- grant access to any part of the M-LINX™ Customer WEB Portal (Order and Transaction) Module or the data and information available to you via such module to any third party except as authorized by Service Provider,
- provide, post, or transmit any data that infringes or violates any intellectual property rights or publicity/privacy rights, or that contains any viruses or programming routines that may damage, interrupt or appropriate the M-LINX™ Customer WEB Portal (Order and Transaction) Module or the data and information available to you via such module or the M-LINX™ system,
- use the M-LINX™ Customer WEB Portal (Order and Transaction) Module or related documentation to create any service offering, computer software program, training materials or user documentation that is substantially similar to the M-LINX™ Customer WEB Portal (Order and Transaction) Module or its related documentation,
- use or facilitate use of the M-LINX™ Customer WEB Portal (Order and Transaction) Module or the data and information available to you via such module in any way that is harassing, harmful, obscene, threatening, libelous, or otherwise tortious, or for illegal, abusive or unethical activities (including violations of law or privacy, hacking or computer viruses),
- attempt to disable or circumvent any security mechanisms used by the M-LINX™ Customer WEB Portal (Order and Transaction) Module or otherwise attempt to gain unauthorized access to any portion or feature of the M-LINX™ Customer WEB Portal (Order and Transaction) Module,
- use any device, software or routine to interrupt or interfere with, or attempt to interrupt or interfere with, the proper operation and working of the M-LINX™ Customer WEB Portal (Order and Transaction) Module or any transaction being conducted on the M-LINX™ Customer WEB Portal (Order and Transaction) Module,
- forge headers or otherwise manipulate identifiers in order to disguise your identity, or the origin of any message or other communication that you send to Service Provider or any other user in connection with the M-LINX™ Customer WEB Portal (Order and Transaction) Module or the data and information available to you via such module,
- use the M-LINX™ Customer WEB Portal (Order and Transaction) Module to process or store any data other than data pertaining to your access and use of the order-related and transaction-related data and other information available to you via such module and contemplated to be processed and stored by the M-LINX™ system, and/or
- permit any third party to do any of the foregoing.
